Good price going by the fact that you are including the ammo and the extra mag and upgraded recoil rod. Just curious but why would not having a CHL require a bill of sale? Good luck with the sale.

That's just how I've been doing it for years. The first gun I bought before I had a CHL many years ago, the seller had me sign a BOS. Ever since then, I've been doing the same thing to buyers without a CHL. I guess it helps protect me since I don't know what the buyers intentions are. Them having a CHL, I know they have a clear background and can legally possess a firearm.

Actually, you aren't accomplishing any protection for yourself by doing this. You have it backwards anyway. You are the one selling the gun. How do we know you didn't steal it or use it to murder a person? The buyer is the only person at risk. The seller has ZERO risk. That being said, if it makes you feel better, I suppose it isn't the end of the world. It is pointless, but not tragic.

Incorrect. It is illegal to sell a firearm to a felon. To cover yourself you must be reasonably sure the person can legally purchase the gun. By requesting a BOS or at least getting the CHL number of the person you have a record of sale and can argue that you felt if the person you sold it to was willing to sign a BOS, then they were not felon or other person who could not posses a firearm.

Kieth,
When I posed this question to a friend of mine who is a lawyer I got a very different response.
The response, it is not illegal for a person to sell a firearm to a felon. What is illegal is selling a firearm to someone you "know" is a felon. These are very important distinctions. He used information from the ATF website to prove his point.
From ATF website:
"A person may sell a firearm to an unlicensed resident of his State, if he does not know or have reasonable cause to believe the person is prohibited from receiving or possessing firearms under Federal law."
A seller has no legal burden to ensure the purchaser is qualified to purchase a firearm. The seller is only in violation if he has knowledge of or has "reasonable cause to believe" that the buyer can't legally purchase a firearm.
Is it a good idea to know who you are dealing with? Yes. Is it a good idea to obtain information from a buyer? Most likely. But your legal exposure to being in violation is ironically less when dealing with someone you know little about.

You are correct JMRA. That was why I said, the buyer is the one at risk not the seller. The buyer could be purchasing a stolen weapon or a weapon that had been in a crime.

Good luck with the sale- looks like a nice clean gun from pics.

While technically right...

Legal and illegal are often different from right and wrong. By holding himself to a higher standard than the law, the OP can have some peace of mind - since he can reason that with a CHL, one is presumed to be clear to buy a gun since he can do so in a gun shop w/o a background check.

I can only assume you didn't read the rest of my post. :banghead:

Nope, I read it... but there is a difference between "knowing" someone and seeing a CHL. (which wasn't clear in your post) I "know" lots of people without a CHL and some do have a background that would deny them a gun purchase. (although they have been model citizens for years now) Seeing the CHL in this scenario gives OP the same peace of mind as if the person bought from a ffl.

To the OP- sorry for the hijack- I hope the extra time this spent at the top helps you sell the gun quickly. :tiphat:
