Natural father shot by CHL step-father over a finger in face

Ya can't make these things up.

A Fort Worth CHL-holder was mad when the natural father of a 7-year old girl brought her home late after going to look at Christmas lights. When the two were arguing, the girl's father pointed a finger at the step-father, who told him he felt threatened by the finger.

Well, you can guess the rest. Murder charges filed, and step-dad has to give up his passport and CHL as a condition of bail.

When police arrived at the scene, Awde told officers that he had shot Nguyen because the man had threatened him by putting his finger in Awde’s face, causing Awde to fear for his life, according to the affidavit.

When later questioned by Pate, Awde acknowledged that, besides pointing his finger, Nguyen never made any threats toward Awde, nor displayed or indicated that he had a weapon. Nor, Awde told police, had Nguyen ever assaulted or threatened him in the past, the affidavit states.

“Based on your training you received when applying for your license to carry a concealed firearm, do you believe that you were justified in shooting Kevin?” Pate asked Awde.

Awde paused, according to the affidavit, then replied, “I don’t know.”

CHL is no issue here at all. The shooter was in his home, and/or on his property. Regardless, this guy should rotten in a cage for life.
After reading the article. The defense would be based on emotional over-reaction (passion defense?) and it would be second degree murder. So sad for a story.

He has essentially already confessed to murder by answering the question about whether lethal force was justified by saying "I don't know."

CHL is no issue here at all. The shooter was in his home, and/or on his property.

Of course his CHL license, and the training he received to be eligible for that license, is an issue. As someone trained to, and licensed by the state to, carry a concealed handgun he should be more aware than the average person of what is and what is NOT a justifiable use of force. And if you don't think the prosecutor will bring that up at his trial, if there is one, then you're living somewhere other than reality.

It is an issue because he had the license and the training. He should have known better. I understand you're saying that it could have happened in a private home without a CHL'er, but in this case it didn't. A guy with training, a background check, and license chose poorly. It reflects poorly on the rest of us and isn't a good statistic.

I recall years ago my builder telling me his wife convinced him not to keep a gun in his truck, like he could have gotten mad enough to use it on one of his subs (or customers!). The step-father was angry & that he had access to a weapon is seriously unfortunate.

The step-father was angry & that he had access to a weapon is seriously unfortunate.

There was a General Contractor I remember from years ago like that. That guy would get madder than a wet hen over the smallest things. He loved running up real close to anyone who dared do something to get his dander up and stomach butt them...LOL. He acted like he was going to attack. Funny thing was, the guy was fat but did not appear to be a tough guy. Just the same, everyone avoided him like the plague. Your story reminded me of him.

Yeah this guy was a GC too and we've met a couple people like him; can be real nice guys until you rub them just the wrong way and then they become (un)holy terrors.

In thinking more about it I'm sure he said that he used to CARRY; then his wife convinced him to keep his gun in his truck. In that way they hoped he'd cool-down if he had to go to his truck to get his gun. We were new to TX at the time and the story sort of amazed us to be honest...
