Great job by the clerk for making Society a little bit safer for us all.

It is unlawful to shoot someone. Chapter 9 of the penal code details where a person would have a defense for committing an unlawful act. A defense to prosecution is not a defense from prosecution, and is a device that can be used in court to show why you should be not guilty.

If you shoot someone, for whatever reason, you are subject to prosecution. That is not to say you WILL be, but you might be......

I don't find the statement disturbing.

The officers are probably not authorized to give information to a reporter.

Ultimately the DA determines if the person will be charged with a crime.

Most public and private organizations have strict protocols about releasing public statements.

The "reporter" is just stating in a round-about way that the person was not immediately arrested and they didn't have any more information if or when charges would be filed by the DA.

It seems to indicate whether the clerk would face charges or not would depend in some way, how many times the man was hit. Did the clerk shoot the guy in the back as he turned and ran out? Did the clerk shoot the guy after he was down?

IMO if someone tries to rob you with any weapon, his butt should belong to you. He could still produce a gun and shoot you even after he is down. Don’t want to take that chance? Shoot him 17 times to make sure. :fire
