travel to another state

if I travel to another state and im not carrying on my person or concealed in car and get pulled over for traffic violation and I give officer my dl and chl and leo asks if I have a weapon and I answer honestly no will my car be probably searched

from what I read on texas chl site you only have to carry chl on you if you are carrying

Why would you offer your CHL to an out of state LEO if not carrying?

I expect (not certain) that having a CHL and declaring "no weapons" is not sufficient PC for a search. Officer would need more than that to searrch you without your consent.

because I have heard when a leo asks for id you should give yor chl also but that may be just in texas and the reason I ask is because when the out of state leo runs your dl wont they find out you have a texas chl anyway

Word of advice.... If you are not carrying don't show your CHL. This is especially true in some of the New England "anti" states or any state that does NOT recognize the Tex CHL.

I've read some discussion here about whether an out of state LEO will get your CHL status if they run your license. Some folks say yes, some folks say no, some folks say "it depends how the request is made".

If I am in a CHL-Friendly state, I will likely disclose...

"Hi Mr. OK Trooper, here is my license. I should probably let you know that Texas may tell you I have a carry permit, but I am not carrying any weapons today."
That would be pretty unusual, since if I'm traveling to OK, I'm almost certainly carrying my gun.

There is no way in hades that I would make that same declaration to a NJ Trooper. Let him ask if he finds out. Then I can say "Heck no!, I heard NJ suspended the Second Amendment many years ago. I'm only here under duress." :mrgreen:

I got pulled one time in Georgia. At the moment I was not carrying, but did choose to present my chl with my license assuming it would show up on his CPU. The officer thanked me for identifying myself, wished me a nice day, and returned to his vehicle. Now that I think of it, I'm not sure he even mentioned I might have been (likely was) going a little fast. I figure the more they knew about me being a "good guy" the better my day was going to go.

the other day while listening to my scanner SO pulled car, deputy ran DL for locals and dispatcher came back and said CHL active, so if LEO ran your DL yes your CHL will probably show up also. I would tell LEO that I have a CHL and if asked if any weapons would say no.

When you travel to another state you must follow the rules for that state. You can find most of them here http://www.handgunlaw.us" onclick="window.open(this.href);return false;. If that states law says you must present your CHL when you present ID, carrying or not, then you are legally required to do so. HOWEVER, unless that state contacts Texas and requests a deeper inquiry into your records, the NCIC (National) database and that states records system database will not have a record of you having a CHL. SO, if you are not carrying or don't have a gun in your vehicle, then you probably would not have an issue if you fail to produce your CHL. If for some reason you got called on it you can plead ignorance and tell them since you did not have a firearm on you, that you didn't know you had to show your CHL.

EDIT TO ADD: I am not sure there are any states that require you to inform the officer of your CHL status if you are not carrying, but if the state law says to inform with or without a firearm, then you legally must do so.

In Texas, LEO will get notified of your TX CHL status.
OP was asking about outside TX.

seems like there are different opinions on my post so I think im going to play it safe and be honest if stopped and give my dl and chl and declare no weapons if im not carrying because first of all I have nothing to hide I was issued a chl in the state of texas which is not a crime and just because I have a chl I shouldn't be hassled for that traveling to another state

It really depends on the state. I wouldn't offer unless I was carrying, which I believe you said you wouldn't be. Especially, if you were in a state that didn't recognize Texas CHL. Offering one up in say MD or NJ seems like asking for trouble, even if they could somehow find out that you had a Texas CHL. Because, to paraphrase former Secretary of State Clinton, "What difference, at (that) point, does it make!!?"

Maybe you were just driving down the street one day (in MD) and you decided to have your Texas CHL on you....w/o your gun. :shock:

Keith gave the correct answer: refer to handgunlaw.us to see the legal requirements for the specific state.

Some states require notification. Some states do not. For example, if you were armed and stopped in Ohio, you have to notify. However, if you were armed and stopped in West Virginia, most definitely do not notify (I know one Ohioan who was stopped in rural WV and notified. The cop was so startled at being notified, he proned the guy out beside the car. When it was all said and done, the WV cop told him to never notify again.) :smilelol5:
