student loan deliquent

Post by kaibusbeesmith »

I have been found deliquent and have been issued a judgement on an outstanding student loan with the texas higher education board. I have made arrangments post judgment and have been making monthly installments to HH Loans to eliminate the judgment anmount. Will this diqualify me from obtaining a CHL or will the repayments post judgment nullify the delinquency?

According to what I have seen from DPS (and I'll look to see if I can find it again) a delinquency judgement renders you ineligible for a CHL/LTC until that judgement is satisfied, and the loan is released by the court.

It looks like it depends on who the collector is. I believe HH utilizes state funds so it may count against you. I'm betting that after a certain number of timely payments they would be willing to remove your delinquent status.
Texas CHL Handbook,
11) has not been finally determined to be delinquent in the payment of a
tax or other money collected by the comptroller, the tax collector of a political
subdivision of the state, or any agency or subdivision of the state;

Delinquent student loans are no longer a bar to being eligible for an LTC. It was until about 2009 or 2011, I can't recall when we removed that provision. I wanted to get taxes and child support repealed also, but there was no support. Even when school loans was a bar, DPS took the position that you were eligible if there was a repayment plan in place and you were paying as set out in that plan.
