Cali, AZ, and NM

Post by mdek »

So, in a couple of weeks I'm gonna be flying to San Jose, from Hobby airport in Houston, and then driving all the way back. Is there anything I should know about having my gun on me in those states?

In the People's Republic of Kalifornia, I plan on keeping it unloaded in a locked case in the trunk of the car, with no ammo in the case.

As far as NM and AZ, I don't plan on going into courthouses, reservations, etc. I believe the only problem would be "liquor establishments". My understanding: in NM, all places that even sell alcohol are off-limits, but does this include parking lots of gas stations where the convenience store might sell drinks? In AZ, it's only on-premises consumption locations that are off-limits. For both states, is there any sort of signage that would indicate these sorts of establishments.

Any other tips or suggestions would be quite welcome.

I think you would be okay doing a "pay at the pump" type of thing in NM. I don't have the statute to know for sure though.

I heard (but can't remember where) that the New Mexico law has been will be amended so that it is/will be illegal to carry in establishments that serve alcohol for consumption on-site. But I can't find anything about this, so it might be waiting to go into effect (like our Castle Doctrine), or it might have been a bill that got shot down at the last minute.

Handgunlaw.us is an excellent resource. I e-mailed them about the update to our car carry laws that will take effect in September, and they promptly replied that they were aware of the new law and would update the web site once it took effect. It might not hurt to e-mail them to see if there are any laws in NM or AZ that could take effect between now and your trip, especially if you trip isn't very soon.
Remember, in a life-or-death situation, when seconds count, the police are only minutes away.

The NM law changed, effective in July. Places where alcohol is served for on-premises consumption are still off limits, but stores that sell alcohol are fine.

So I assume this is another state that would restrict you from carrying in all restaurants that serve alcohol either at a bar in the establishment or at the tables where you eat...

This to me has always been a tough issue for those states that do this...Been a tough nut to crack...

In a way I'm glad Texas managed to not get caught up in that absolute condition...The 51% deal seems to have work out fairly well...

Oh well, there is always room for improvements in these laws...

what exactly is the law in Az. I've looked all over HandGunLaw.us, and even the State's site, and can't find any definitive statutes for where, what kind, how, all that good stuff.
kthxbye

There's a good list of where not to carry at the bottom of page 5: http://www.handgunlaw.us/documents/USOffLimitsA-M.pdf

I just liked the way packing.org presented its data, telling not only off-limit places, but also other rules, such as only being allowed to carry one gun at a time. Too bad it's hopelessly out of date, on the rare occasions that the site is even working.

well, I've heard many a person say that Az is open carry, but I couldn't find anything that said so. It does say they issue Concealed licenses, and they honor the Tx license, so that's fine with me, but I'm just wondering about the OC thang.
same with NewMexico. thanks for looking mdek

See http://www.opencarry.org/.

This is the Arizona equivalent of Texas's Chapter 46 (weapons): http://www.azleg.state.az.us/ars/13/03102.htm

Note that school grounds are off-limits.

The problem with "proving" something is legal is that you have to search the entire code to be sure it is not illegal. I have been told many times that open carry is legal in Arizona, and I've seen people doing it.

thanks Jim.
yeah, I remember reading that Statute thinking, "well, like Tx, if it doesn't preclude, that must mean it includes..."
don't want to be wrong, though...
