Hurricane Dolly Looter Shot
Always Remember:
A firearm is only an instrument. It contains no evil, no conscience, and no ability. It is strictly the intent, competence, and character of its user that decide the outcome of any and all actions taken with it.
(I don't know who deserves credit for this quote, but I like it.)

Armed felon will beat the grand jury for the shooting itself.
He WILL get convicted for possessing a gun as a felon.
His wife will get a reduced sentence for arming a felon and obstructing justice.
IMO.

I am torn as to how I feel about the situation. The owner was wrong, but due to the weather situation and known potential for looters, I would have probably done something similar.
I believe that if I was on the grand jury I would have to "no bill" the business owner, and since the illegal that actually did the shooting can't be found, I don't see that there is much you can do with him.

She should be prosecuted for employing an illegal, arming a felon, interfering with an investigation, and for the death of the thug. If she was so worried about her store, she should of stayed and protected it instead of arming a drug dealer.

FTA: ""Ms. Lopez gave a convicted felon a firearm," Treviño said. "That's against the law. She lied to us from the onset of the investigation. That's against the law.""
Giving a convicted felon a firearm is against the law.
However, it's only against the law to lie to Federal law enforcement personnel. It's not illegal to lie to state/local law enforcement - unless the law's changed in the 12 years (wow, has it been that long?) since I've been a cop. Maybe he's referring to an obstruction of justice or interfering with a police investigation charge.

One of the more recent changes to filing a false police report is that it now includes lying to a police officer about something material to an investigation.Kythas wrote:However, it's only against the law to lie to Federal law enforcement personnel. I don't think either person should be charged with shooting the burglars.
As for the other charges, they're understandable. Not only was the shooter here illegally, but he had already been deported for committing crimes when he was here previously. He needs to go away and stay away. As for the store owner, she's either incredibly stupid or lacks a conscience. Either way, she deserves all of the charges except murder or accessory (sp?) to murder.

I'm sorry, but if you're hiring illegal felons, this type of thing might happen to you. prayers all the way around, and the wheels of justice will turn.

While the person who supplied the firearm to the felon should be charged with that crime and anything dealing with the harboring of an illegal, I do not think she should be charged with the homicide, if he was within his legal authority to use deadly force.
This boils down to, if a guy was convicted of a felony years ago, but his wife owned a gun, can he not use the gun to defend himself in his home against an intruder? I can see and support him not being able to get a CHL or able to have a weapon in his car, but if he is in his own home, he should have the right to protect himself as much as anyone else.
