Actually, Nassau does not fall under the control of Bloomberg. They are their own, misinformed, ignorant bunch out on Long Island. :lol

What, the state laws says, "no preemption, except NYC"?hirundo82 wrote:NYC has always had a special status in New York firearms laws.i8godzilla wrote:So what does this do to NYC's litany of hand gun laws?
I am not a lawyer, nor have I played one on TV, nor did I stay at a Holiday Inn Express last night, nor should anything I say be taken as legal advice. If it is important that any information be accurate, do not use me as the only source.

I will admit that I am not an expert on New York laws (or any other state).Dave2 wrote:What, the state laws says, "no preemption, except NYC"?hirundo82 wrote:NYC has always had a special status in New York firearms laws.i8godzilla wrote:So what does this do to NYC's litany of hand gun laws?
The following is directly from the ruling:
SUPREME COURT OF THE STATE OF NEW YORK wrote: http://www.nycourts.gov/reporter/3dseri ... _09911.htm" onclick="window.open(this.href);return false;
The amended ordinance interrupts this uniformity by imposing an additional requirement for lawful possession of a valid firearms license beyond the State's requirements. For example, under the amended ordinance, a holder of a license to possess a firearm who enters Nassau County with such firearm, does so at the risk that his or her handgun may be considered to be deceptively colored," thus subjecting him or her to charges of violating the amended ordinance. In effect, the amended ordinance places a restriction on all licenses granted throughout the state, and deprives all licenses that were lawfully granted to owners of "deceptively colored" firearms of their stated benefits. If each of New York's 62 counties enacted ordinances that placed additional restrictions on licenses, as the amended ordinance effectively does, the uniformity in firearm licensing that the Legislature intended would be destroyed.
Then there is this:
Wikipedia wrote: http://en.wikipedia.org/wiki/List_of_co ... n_New_York" onclick="window.open(this.href);return false;
There are 62 counties in the State of New York.
I believe that NYC includes five counties that have no real functional county government.
No State shall convert a liberty into a privilege, license it, and charge a fee therefor. -- Murdock v. Pennsylvania
If the State converts a right into a privilege, the citizen can ignore the license and fee and engage in the right with impunity. -- Shuttleworth v. City of Birmingham

And that is written right into the state Penal Code, therefore preemption is nullified.hirundo82 wrote:NYC has always had a special status in New York firearms laws. For example, handgun permits issued in the rest of the state do not allow carry in NYC, and rifles and shotguns require a permit to own in NYC but not in the rest of New York.i8godzilla wrote:So what does this do to NYC's litany of hand gun laws?
Real gun control, carrying 24/7/365

As I sit here in New York reading this unarmed of course. I have to say those who can't get promoted.
Let's keep him in New York or he just might run for President.
See y'all back in the great state of Texas this afternoon.
Thank my lucky single star, it can't be soon enough.
