Bonidy vs USPS

Post by Jasonw560 »

I am slipping. :banghead:

There was a motion to dismiss this case on Monday. I usually check the judge's calendars religiously, but I haven't.

I'll let y'all know what I find out.

The judge dismissed the case, but said that Mountain States Legal can file an amended compliant.

The lawyer handling the case, Jim Manley, emailed me the amended complaint. When I get a chance later tonight, I'll attach it so we can all read it.

Edit: correct the lawyer's name.

Here's the reply I received:
Good to hear from you. The USPS has filed another motion to dismiss, claiming that the Second Amendment does not apply to postal property. We intend to file a response in opposition this week. The USPS will then reply and after that I expect a quick decision from the court. We might have a decision in June or July, but it is at the judge's discretion.

I will keep you posted as the case moves forward.

Best,
Jim Manley

Any questions or facts from anyone that Jim Manley could offer up in their opinion this week? Or just in general?

...I would argue that the Post Office is a publicly-supported facility...not highly charged with emotions as a courthouse is, and, given the common knowledge among criminals that you don't want to mess up in a Post Office because of severe penalties, there's no justification to inconvenience their law-abiding customers...and no reason to expect any problems from us just because we carry...any more than a grocery store...once again, they're punishing the majority because of the actions of a miniscule minority...
